What is a Lease Amendment?

An Amendment to Lease Agreement, also known as a lease modification agreement, is a document that describes any changes, revisions, or additions to a Lease Agreement that a tenant or landlord may make. It is also known as a lease addendum or a lease modifying agreement. You may need a lease amendment if:

➤ You are a landlord who desires to modify an existing lease
➤ You are a tenant who wishes to make some lease changes to your landlord
➤ You and your current tenant have discussed lease modifications and would like to formalize the agreement
➤ You and your landlord have agreed to modify some lease terms, and you want a written record of these modifications

If conditions have changed since the initial Lease Agreement was signed, a formal modification to the Lease Agreement may be required. This can involve adding a new tenant, changing the rent amount, or renewing or extending a contract. When making minor, straightforward adjustments to a Lease Amendments come in handy.

When to use a Lease Amendment?

What laws apply in Philippines?

The modification might take the form of changing an existing provision in the Lease Agreement, adding a new provision to the Lease Agreement, or removing a provision from the Lease Agreement. In all situations, the adjustments must be approved by both the lessor and the lessee. If one of the parties does not agree, the original Lease Agreement will remain unchanged.

The Civil Code of the Philippines covers contract and lease law. Furthermore, Republic Act No. 9653 (the “Rent Control Act”), as amended by Housing and Urban Development Coordinating Council Resolution No. 1 Series of 2017 (“HUDCC Resolution No. 1”), controls leasing arrangements that meet the following criteria:

1. The property is in the National Capital Region or a densely populated city, and the total monthly rent ranges from one peso (PHP 1.00) to ten thousand pesos (PHP 10,000.00)

2. The property is in various neighborhoods, with monthly rent ranging from one peso (PHP 1.00) to five thousand pesos (PHP 5,000.00).

What is included in a Lease Amendment?

A Leasing Agreement is a legal agreement in which the owner of a residential property (landlord) rents (leases) it to another person (the tenant). The commercial landlord receives an agreed-upon quantity of money from the tenant over a predetermined time period in exchange for the use of the premises.

The following clauses are typical of a Lease Amendment Agreement form:

➤ The names and addresses of the landlord and tenant
➤ Residential property information
➤ The expiration date of the previous lease agreement
➤ Modifications to the original lease agreement
➤ Statement detailing the original agreement's non-changing clauses, such as contact and financial information
➤ Real estate legislation governing lease revision and preservation
➤ The formal signing of the lease terms' parties
